A buyer of real property in Mexico may take title in his own name (direct title) only if he is a citizen as evidenced by a Mexican passport. This person will pay for several documents to be created as required elements before he can receive registered and complete title documents in his own name. In addition, he must pay transfer taxes and for the services of a Notario.
A foreigner, such as a US citizen, will need to pay all the costs listed above plus the costs for a legal instrument to hold title if the property is in San Felipe. The appropriate instrument to hold title to residential property is typically a bank trust, a fideicomiso. The buyer typically pays all the fees for the fideicomiso directly to the bank. |
